CoolOrca.com, Inc. does not sell hunting and sporting weapons and related accessories and ammunition, but allows You to sell them on our platform with the full responsibility of the Seller/Customer.

The U.S. Department of State's Directorate of Defense Trade Controls, the U.S. Department of Commerce's Bureau of Industry and Security, and the U.S. Department of the Treasury's Office of Foreign Assets Control administer export control regulations that affect some aspects of our business. Please, read and familiarize yourself with the following regarding certain applicable sales and export regulations.

CoolOrca.com, Inc. will not engage in any transaction that requires the illegal export of any goods and will not assist directly or indirectly with the illegal export or re-export of any products. An accurate Automated Export System (AES) filing must be made, whether or not the exportation requires a license. The sale, transfer, transportation, or shipment outside of the U.S. of any product prohibited or restricted for export without complying with U.S. export control laws and regulations, including proper export licensing, documentation or authorization, is strictly prohibited and may result in civil penalties and/or constitute a federal crime.

If you wish to purchase an item for ultimate shipment or use outside of the United States, please indicate this fact in your order. Depending on the value of the order, specific item(s), end user, country of ultimate destination and end use, Seller may be required to apply for an export license with the appropriate U.S. government agency.

Several goods may require an export license, including, but not limited to, the following: optical sighting equipment and tactical lights (both hand-held and weapon-mountable), accessories, and mounting hardware; generation 2, 3, or 4 night vision equipment and night vision accessories; knives; military apparel including body armor, helmets and helmet accessories, and shields; thermal imaging equipment and heat seekers; tactical gear and weapon accessories; some electronic equipment and some laboratory equipment.

Some of the goods are subject to the International Traffic in Arms Regulations (ITAR), and export is strictly prohibited without authorization or a license issued by the U.S. Department of State's Directorate of Defense Trade Controls.

By proceeding with a transaction to purchase any ITAR restricted item(s), the Customer certifies that the purchase does not require CoolOrca.com,Inc. to export such items, unless CoolOrca.com,Inc. is aware of the export and has obtained the appropriate U.S. Government authorization;  the Customer does not intend to export such items after receipt from CoolOrca.com,Inc. without the appropriate U.S. Government export authorization;  the Customer does not intend to export, transfer, sell, or furnish the item to any foreign person, whether abroad or in the U.S., including any Foreign Embassy in the U.S., without the appropriate U.S. Government export authorization; the Customer understands that a foreign person under the ITAR § 120.16 means "any natural person who is not a lawful permanent resident as defined by 8 U.S.C. § 1101(a)(20) or who is not a protected individual as defined by 8 U.S.C. § 1324b(a)(3)," and can mean "any foreign corporation, business association, trust, society, or any other entity or group that is not incorporated or organized to do business in the U.S., as well as international organizations, foreign governments, and any agency or subdivisions of government (e.g. diplomatic missions)" (See ITAR § 120.16);  the Customer is a U.S. Person as defined by ITAR § 120.15, meaning the Customer is a lawful permanent resident of the U.S., as defined by 8 U.S.C. § 1101(a)(20), or is a protected individual as defined by 8 U.S.C. § 1324b(a)(3), or is a "corporation, business association, partnership, society, trust, or any other entity, organization or group that is incorporated to do business in the U.S., or is a governmental (federal, state, or local) entity" (See ITAR § 120.15).

Important Export Restrictions.

1). Export of some products is strictly prohibited without a valid export license issued by the U.S. Department of State, in accordance with International Traffic in Arms Regulations (ITAR) (22 C.F.R. 120-130) or a valid export license issued by the U.S. Department of Commerce, in accordance with the Export Administration Regulations (EAR) (15 C.F.R. 730-774).

2). U.S. law prohibits the sale, transfer, or export of items to certain restricted parties, destinations, and embargoed countries, as identified on lists maintained by the U.S. Department of State, the U.S. Department of Commerce, and the U.S. Department of Treasury. It is the responsibility of the Customer to be aware of these lists, which can be found at the following U.S. Government websites. By proceeding with any transaction, the Customer certifies that the Customer will not engage in any unauthorized transaction involving the export of products to any restricted parties or destinations. CoolOrca.com, Inc. reserves the right to inquire into the end user, end use, and country of ultimate destination of any product ordered on this website. Export control laws and regulations are complex. Any summaries of such laws and regulations provided by CoolOrca.com, Inc. herein are not comprehensive and are not to be taken as legal advice or counseling.

Any controversy or claim arising out of or relating to Customer's purchase of any product from Seller on our website shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

Buying or Selling any goods (meaning - hunting and sporting weapons and related accessories and ammunition) on our Website, you certify that you have read and understand all conditions.

Each seller must have his own sales policy (rules) of hunting and sporting weapons and related accessories and ammunition sales, which is legal in the country of the Seller and in the country of the Buyer, and does not contradict international standards of trade in this category of goods.

Clients of our website (Sellers and Buyers) are required to comply with any and all requirements without exception imposed by applicable federal, state and local laws, regulations and administrative policies, in accordance with international standards, and also not in conflict with laws in the Buyer's country and the Seller's country.

 

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will post a notification on the main page of our Website. Continued use of the Website after any such changes shall constitute your consent to such changes.

 

Weapons (UK Regulations)

The content below is for guidance only. CoolOrca reserves the right to remove any listing it considers to be inappropriate for sale for any reason.

Examples of Permitted Listings

Reminder: all listings and products must comply with all applicable laws and regulations.

Items classified as weapons under UK legislation including, but not limited to the Firearms Act 1968 and the Criminal Justice Act 1988 are prohibited. Certain knives are allowed to be sold, subject to being shipped with a permitted age verification on delivery method. A permitted age verification on delivery method is where a signature on delivery and ID is requested if the recipient appears to be under the age of 21.

The following are not classified as weapons:

  • Bows/hunting bows provided they are not classified as weapons under the relevant legislation
  • Self-defense sprays that stain an attacker’s face provided they do not contain irritants
  • Bullets for BB and airsoft guns that are not classed as ammunition
  • Toy guns provided they are not realistic
  • Pallet knives
  • Pruning saws, topiary and other shears, and secateurs
  • Saw blades
  • Carving and toasting forks
  • Scissors
  • Knife sharpeners
  • Razor blades permanently enclosed in a cartridge or housing with less than 2 mm of blade exposed
  • Knives included in ordinary cutlery sets with forks and spoons
  • The following knives and bladed products (provided that all merchant fulfilled orders are shipped with a permitted age verification on delivery service):
    • Folding blades which are not capable of being locked open
    • Kitchen knives, including cheese and steak knives
    • Folding blades that are part of a multi-tool device
    • Electric carving knives

Examples of Prohibited Listings

  • Firearms, including pistols, rifles and shotguns
  • Airguns and airsoft guns, including BB and paintball guns
  • All associated parts, kits and ammunition for firearms
  • Accessories which assist the use of firearms (for example, silencers and converters)
  • Antique and replica/imitation guns, including replica bullets
  • Deactivated weapons
  • Weapons designed to fire blanks (including starting pistols)
  • Black powder and all explosives
  • Prohibited explosive precursors
  • Grenades
  • Military weaponry
  • Stun guns and tasers
  • Blowpipes or blowguns
  • Harpoons/spearguns
  • Crossbows
  • Slingshots/catapults except for children’s toys
  • Batons and telescopic truncheons
  • Tear gas
  • Pepper spray and mace
  • Weapons designed to be concealed or disguised
  • Swordsticks and hollow kubotans
  • Brass knuckles, knuckledusters, handclaws and footclaws
  • Nunchaku/nunchuks
  • Shurikens, throwing knives and death stars
  • Kusari, kusari gama and kyoketsu shoge, being a length or rope, cord, wire, or chain fastened at one end to a sickle, knife or hard weight
  • Knives and blades, other than as listed in the permitted products section above, including but not limited to:
    • Flick knives or flick guns
    • Gravity knives
    • Belt buckle knives
    • Push daggers
    • Balisongs or butterfly knives
    • Disguised knives
    • Zombie knives
    • Meat cleavers
    • Razor blades, except if enclosed in a cartridge or housing with less than 2mm of the blade exposed
    • Axes
    • Stanley knives and blades
    • Hunting knives
    • Diving knives
    • Machetes and Kukri/Khukuri Machetes
    • Bill Hooks
    • Scythes
    • Swords
    • Any other article which has a blade or which is sharply pointed and which is made or adapted for use for causing injury

Please note: Sellers who list prohibited items or content can have their selling permissions removed, either temporarily or permanently.
